Welcome to the DUI Conspiracy blog. Have you or anyone you know been the victim of a dui? Even though you weren't drunk, you are then taken away in a police car and thrown in jail? Sound familiar? What a scam our legal system is pulling on our already struggling middle class. Forget about the mortage, credit crisis affecting hard working Americans. The bigger and more frightening problem is on the streets you drive each day. Judge Felts: Indiana man of conspiracy

We all like hearing stories about celebrities and politicians screwing up. In America, it's fairly common to hear about scandals, corruption and crime. Here is the saga of Thomas J. Felts, Allen County, Indiana Circuit Court Judge. Mr. Felts has sentenced hundreds of DUI offenders to a controversial program called AADP (Alcohol Abuse Deterrent Program). This program administers a drug called Antabuse, a drug thats causes serious health problems. More on Antabuse in a later post. Let's get back to the wonderful Judge Felts. Here's what happened that July night in Indy:

At around 2:30 am on July 18, 2008, Mr. Felts was stopped in Indianapolis for speeding and not using a turn signal. As they pulled him over, he put his car in reverse and backed in to the police car. The officers noticed his speech, appearance and the smell of alcohol and suspected him of driving drunk. He failed the field sobriety tests and weakly blew into the breathalyzer machine. His BAC was .14, almost twice the legal limit. When they got him back to the station, he tried to conceal his BAC by not blowing long enough in the machine and by burping into it. According to the cops, that was like refusing a test, which gets your license suspended for a year. So they took his license away and charged him with DWI (thats what they call drunk driving in Indiana). He pleaded guilty to the charges and received a suspended sentence of 1 year in jail. He was also put on probation for a year, had to pay a fine of $700, had his license suspended for 90 days and was ordered to get treatment. He was also "reprimanded" by the Indiana Supreme Court for his actions.

This story proves that if you're famous or you are in Government, you can get away with much more than your typical American!!!! A judge who deals with DUI's gets one and is essentially given a "slap on the wrist", not to mention that he is still currently on the bench. So getting back to regular American Joe: He gets a DUI and his life gets ruined. This hypocrite gets one and it's business as usual. Am I crazy, or does that seem a bit unfair to me???

A bloody conspiracy

Some police departments across the country are implementing a new tool in the "war" against drunk driving. Police in Texas and Idaho are being trained to draw blood from suspected offenders. The program, sponsored by the National Highway Traffic Safety Administration, would let police forcibly draw blood from persons suspected of driving drunk. The program is in a trial stage, but if it is successful, it could be implemented across the country. So basically this means that even if you refuse a breathalyzer test, the cops can and probably will draw blood from you. The sad thing is that taking blood by force is perfectly legal. The US Supreme court said that the cops can use force to get your blood, without a warrant, as long as they have reasonable suspicion that you've been driving drunk. Not only is this another invasion of privacy, these tests could possibly convict the wrong person. The vials of blood could get mixed up or they could be improperly stored, causing the blood to ferment and make the alcohol content higher. Another issue would be an officer who was improperly trained drawing blood from somebody, causing injury and possible medical malpractice. Most cops have no medical or paramedic training, so I would feel very uncomfortable having a cop stick a needle in my arm. I hope this study goes down in flames. If it is successful, you can kiss more of our civil liberties good-bye.

S.U.I.: Sleeping under the influence

Apparently you can also get a DUI if you sleep it off in your car. In 2007 a man was convicted of a DUI after he was found sleeping in his car with it running and in park. The man told the cops it was cold outside (it was February in New Jersey) and he left it running to stay warm. Well, to make a long story short, he was arrested and convicted of DUI and had to pay over $4000 in fines and costs. In most states, having "control" of the vehicle means being in it, even if you're in the back seat sleeping it off. In other words, you don't have to be driving the car to get busted. Now common sense would tell you that if you think you are too drunk to drive, don't drive. I would think that people would appreciate it if you chose to pass out in the back seat instead of driving home. Yet if you are found passed out in your car, even though your keys are not in the ignition, you will be slapped with a DUI. The cops can also arrest you if your car is broke down and inoperable. So that means you can't go to the bar and wait for the tow truck without risking a DUI. So what is next?? Will the cops arrest the guy who is sitting at home drinking because he may decide to drive?? As crazy as this sounds, sleeping in the trunk may be your best solution. Most newer cars have a release lever inside the trunk in case you become trapped inside. It may be uncomfortable, but it's better than a DUI conviction!!!

....And justice for all

On March 14th of this year, Browns WR Donte Stallworth was in Miami, Florida when he struck and killed Mario Reyes, a 59 year old construction worker who was going home after working his third shift job. It was determined that Stallworth was legally drunk at the time and that he flashed his lights at Reyes, who was not in a crosswalk. Subsequently, he was charged with DUI manslaughter and sentenced to only 30 days in jail. He was also suspended for a year by the NFL, received two years house arrest (he can still play football after his suspension) and lost his driver's license for life. So the message thats being conveyed here is that if you have money you can get away with murder, right?? If this was Joe the regular American, they would've spent years in prison, not jail. Their life would be ruined. Stallworth gets to spend 24 days in jail, take a year's vacation and continue making millions playing football. To me that seems like some lopsided justice. It is obvious he got preferrential treatment in this case, because of who he was and what his profession was. Not to mention that he had just received a signing bonus from the Browns that day!!! So in other words, to beat a DUI you need to be rich and famous, otherwise you get the book thrown at you.

About DUI traps, i mean checkpoints

Here is another DUI conspiracy that the DUI lawyers hate: The sobriety checkpoint. What is the checkpoint? The police set up a roadblock on a road and stop vehicles. If they suspect you are driving drunk, they will arrest you. Not only do they arrest alleged DUI suspects, they also issue citations for various things like suspended licenses, equipment violations and warrants. Do these checkpoints violate civil rights?? You bet they do!!! These drivers are stopped even if they haven't been drinking and may be given a breathalyzer test without probable cause. The breathalyzer test is another issue. If you refuse this self-incriminating test, the penalties are the same as if you would blow more than .08. So if you choose not to incriminate yourself, you're still getting screwed. Some also think these checkpoints violate the 4th amendment which protects against illegal search and seizure. Although the Supreme Court ruled these searches legal, they did set up some rules, such as advanced warning of the time and location of these searches. Oh yeah, I almost forgot to mention they usually only catch a small number of DUI suspects. All it is is a money making scheme to violate people of their civil rights. So be careful and avoid these "traps".

It seems that the majority of Americans would agree that the government plays too big of a role in our daily lives. This is also the case with DUI laws. In many countries around the world the legal age to drink is 18. (In England, children as young as 5 can drink under supervision; in Moldova there is NO drinking age for beer!!!) In the good ol' US of A the age is 21. Who is responsible for this?? Well, the government is, but who pushed this law upon us Americans?? MADD, of course. MADD, like other lobbyists in Washington, urges Senate and House members to pass laws favoring their agendas. So in 1984, Congress passed the Minimum Drinking Age Act forcing the states to change the age limit from 18 to 21. This was required: if states did not comply, they would lose 10% of federal highway funding. They also did this with the blood alcohol limits. It used to be .10. Then in 2002, with the threat of losing fed road funds, it was lowered again to .08. Another example of the government, with MADD's help, telling us what not to do and punishing us for ridiculous reasons.

What's up with the party plates??

In the State of Ohio, if you get a DUI, the state has plenty of little gifts for you. The suspension, the 3 day weekend and the SR-22 are common elements of this little "package". In addition, you are presented with your own "vanity" license plate. It is yellowish orange and is bright enough to see a mile away. It signifies that you have been convicted of a DUI and that other drivers should steer clear of you if they see you coming. Now I dont know about you, but this seems a little bit discriminatory to me. If we're gonna start singling out groups of people, how about we start giving out green license plates to corrupt politicians??? There are sure plenty of them out there!!! I always thought discrimintaing people was wrong, but apparently Ohio thinks it's okay as long as these plates cost more than regular ones. I wonder if MADD gets a cut of those fees. They probably do because they probably came up with a silly idea such as this. So when Joe the plumber (or electrician or you can fill in your own profession) wants to have a beer after work, he better be careful. That beer or two can cost him alot more than the $4.50 he spent on it!!!

The DUI Conspiracy

Are DUI laws a conspiracy? Should American drivers be robbed of their rights, just because they enojoy a few beers? It seems the laws of this country want to incriminate non-criminals, and turn every hard working American citizen you enjoys a beer after work into a criminal. Is there ever going to be any justice for the millions of Americans who have been robbed of their American god given rights?

Driving While Texting

Texting while driving seems like a bad thing to do. Can someone accurately focus on the road while texting? I mean with drinking and driving, you are in control of your driving, as long as your not at least .20 blood alcohol level or something like that. But with texting, your not looking at the road while you text. Well, some people might be able to do this, a lot will not. But the funny thing is, I can understand having laws against texting while driving. Should they also have the same penalties as dui laws? Should someone getting caught texting while driving, lose their driver's license for 1 - 5 years, go to jail, and be loaded up with $10,000 or more in court costs and fines? Since it appears texting while driving is more dangerous than drinking and driving, why does the penalty not match the crime? Doesn't make a lot of sense. That's why until someone can tell me why dui laws are the way they are, I would logically have to believe that dui laws are conspiracy against America's alcohol drinkers. When the punishment doesn't even come close to the severity of the crime, you really have to start questioning what is going in this country and why.

Does Prohibition Still Exist?

Is anybody even mildly intoxicated off 2-3 beers? Everyone keeps saying don't drive even if you have had 1 beer. What? What country do we live in again? I didn't know prohibition still existed. I thought we got passed that back in the 30's. I guess I was wrong. Or this a way to steal from hard working Americans you enjoy a couple beers at their local bar after work and then drive home. Oh, but wait, DUI checkpoint was set up. So now that innocent man has to lose $10,000. Ridiculous! I hope more people don't stay home because of this. Fight back! We say this is a free country with sensible and reasonable laws, so why aren't we fighting for them! Don't let MADD or the law impose Nazi like restrictions on your freedom. It's time we take this country back and protect the hard working Americans you enjoy a few beers after an honest days work.

Were DUI Laws a Factor in The Auto Crisis?

I don't know if stealing cars from hard working Americans who have a couple beers after work affected auto sales in this country, but I'm sure it didn't help. It's also hard to purchase a car without a drivers's license. It's amazing how in the last 5 years, how many people I know who no longer have a driver's license, let alone a car. These people at one time had cars, yet know have to take a taxi or walk to work, because they are victim of dui laws. Out of the 20 friends I can think of off the top of my head, about 15 of them don't have a car. They all have jobs and support their families, yet they no longer have a car in their driveway. I'll have to look in to some the statistics on this and get the facts. Anyone have any information on this?

The Insanity Of DUI Laws

As we all know there are those annoying traffic laws out there. Run a stop sign or red light, or make a u-turn when you weren't supposed to and you get a ticket for $100 or so. Yes I know we need these laws to keep everything in order on our streets. But what if you did this after 2 beers? Did you know that now you may lose $10,000 instead of $100? You may also lose your license for 1, 5, or 10 years and go to jail. Sound crazy? Well it is, and it is happening on the streets you drive each day. The dui precedent of 0.08 is about 2-3 beers in the average adult. Do you feel drunk after a couple? I don't feel anything and I know that my driving isn't impaired. But somehow the law feels they have the right to throw you in jail, load you up with fines, lawyer fees, treatment, and jail time. I don't know about you, but I thought we live in a free country, with laws that make sense. I guess me and the other millions of Americans who have been robbed by our legal system were wrong. If anyone would like to explain the other side, feel free to do so.

Why are DUI Laws So Strict?

You might think that DUI laws are strict because of the dangerous accidents that have occurred while someone driving was intoxicated. Makes sense. But what about all the fatal accidents that occur from sober drivers? What about drivers who are talking on their cell phones, or are listening to loud music or driving out of control because of road rage. Why aren't they treated the same as a DUI driver. We already know that more fatal accidents occur from sober than drunk drivers. So why aren't we banning sober driving? Well, that may be a stretch, but seriously why do we have such crazy laws that make no sense.

Well, the answer is of course the almighty dollar. That's right, politicans and activist just found a way to steal money, and there taking it as far as they can until people start standing up against it.
